Documentary credits
The rules that govern almost every letter of credit worldwide. Summaries here are in my own words; always check the official ICC text for exact wording.

What is a letter of credit?
An LC is a bank's promise to pay the seller, provided the seller presents documents that comply with the credit's terms. The bank looks only at the documents, never at the goods. That single idea explains most of how LCs work.

Reading an MT700
An LC usually arrives as a SWIFT MT700. These are the fields I check first, and what to look for in each.
What to check on each document
Commercial invoice
- Appears to be issued by the beneficiary
- Made out in the name of the applicant
- Same currency as the credit
- Goods description corresponds with the LC
- Need not be signed unless the LC asks
Bill of lading
- Names the carrier and is signed by the carrier, master or a named agent
- Shows goods shipped on board, with a date
- Port of loading and discharge as stated in the LC
- Full set of originals, if issued in more than one
- Clean: no clause showing defective goods or packing
Insurance document
- Issued and signed by an insurer, underwriter or their agent
- Dated no later than shipment, unless cover starts from shipment
- At least 110% of the CIF or CIP value if the LC is silent
- Same currency as the credit
- All originals presented if more than one was issued
Draft, origin certificate and others
- Draft must not be drawn on the applicant
- Amount within the credit amount and tolerance
- Certificate issued by the party the LC names
- Data does not conflict with other documents
- Content appears to fulfil the document's function

ISBP 821 · International Standard Banking Practice
Examination practice
UCP 600 says documents must comply with "international standard banking practice". ISBP is where the ICC writes that practice down, document by document.

What it is
A companion to UCP 600, published by the ICC Banking Commission. ISBP 821 replaced ISBP 745. It does not change UCP 600; it explains how examiners apply it.
How it is organised
General principles first, then a section for each document: drafts, invoices, transport documents, insurance, certificates of origin, packing and weight lists, beneficiary's certificates and inspection certificates.

Demand guarantees
Rules for guarantees and counter-guarantees payable on a complying demand, such as performance, advance payment, bid and retention guarantees.

Documentary collections
Banks pass documents from seller to buyer and release them against payment or acceptance. Unlike an LC, no bank promises to pay.

Documents against payment
The buyer gets the documents, and so the goods, only after paying. Usually at sight.
Documents against acceptance
The buyer gets the documents after accepting a bill of exchange to pay at a future date. The seller carries the credit risk until then.

Bank reimbursements
When a nominated bank pays under an LC, it often claims its money from a third bank, not the issuing bank. URR 725 governs that claim.

Delivery terms
Eleven three-letter terms that settle who arranges transport and insurance, who clears customs, and where risk moves from seller to buyer. The term chosen shapes which documents the LC asks for.

Any mode of transport
EXW, FCA, CPT, CIP, DAP, DPU, DDP. Use these for containers and multimodal shipments.
Sea and inland waterway only
FAS, FOB, CFR, CIF. Best for bulk cargo loaded directly onto a vessel.
Terms and the LC documents that usually go with them

Under FCA, the parties can agree that the buyer's carrier issues an on-board bill of lading to the seller, which helps when an LC requires one.
ISP98 · International Standby Practices
Standby credits
A standby LC works like a guarantee: the bank pays only if the applicant fails to perform. UCP 600 can apply to standbys, but ISP98 was written specifically for them.

Where standbys are used
Common in the US and in cross-border lending, where banks there have traditionally issued standbys instead of guarantees. Used to back loan repayment, performance, advance payments and trade payables.
Why separate rules
Many UCP 600 articles deal with shipping documents that a standby never sees. ISP98 deals directly with demands, statements of default and the realities of standby practice.

Electronic presentation
The eUCP adds rules for presenting electronic records, alone or together with paper documents, under a credit subject to UCP 600.

How it works with UCP 600
The credit must state that it is subject to the eUCP. UCP 600 still applies, and the eUCP adds or adjusts rules where electronic records are involved. Where they conflict, the eUCP prevails.
Why it matters
Electronic bills of lading and digital trade platforms are growing. Banks and exporters need clear rules on when an electronic presentation is complete and what happens if a record cannot be read.

Work out the last day to present documents, the bank's examination deadline, and whether shipment was in time.
If the LC is silent, UCP 600 Art. 14(c) sets 21 calendar days after shipment. Art. 29(a) moves a last day that falls on a bank holiday to the next banking day.

Usance bill maturity
The due date of a usance draft, adjusted for bank holidays at the place of payment.
Under ISBP, "from" and "after" a date both start counting on the following day, so 90 days from 20 October matures on 18 January. If maturity falls on a day the bank is closed, payment is due on the next banking day.
